Chinese LED companies must be vigilant in the road of export


China's LED industry exports have a certain foundation, basically divided into three categories:

First, LED display products. According to the LED Display Application Industry Association's statistics on member units, this part of the current total export volume is about 1.1 billion yuan, accounting for nearly 20% of the total LED display screen of 6.01 billion yuan. Nationally, the export of LED displays is estimated to account for about 15% of sales.

Second, LED device products, this part may be mostly OEM.

Third, LED application products, such as signal lights, flashlights, lighting, etc., have a certain scale.

The current LED export is still based on products in the packaging and application sectors. At present, the overall export scale of landscape lighting is limited, but from the perspective of development, foreign markets are an important market that cannot be ignored in China's LED industry, and the potential for the future is great.

China's LED industry has two weak links in the face of intellectual property disputes: on the one hand, we have very limited understanding of the laws and regulations on intellectual property protection in other countries in the world, and we are in a state of being helpless. On the other hand, in the face of the high response fees of international intellectual property litigation, the ability of enterprises to undertake is also very limited.

From the countermeasures, we must face it positively, but the power of relying solely on individual enterprises is very limited. The intellectual property litigation proposed by foreign countries actually has strong pertinence, strategy and purpose, even though it is held by individual patents. Some people or individual enterprises are the object of their own, which is aimed at China's entire industry, is a manifestation of trade friction between countries, and may even have an international political background. For the handling of such cases, the majority of enterprises in the industry should actively cooperate to safeguard the overall interests of the industry. At the same time, relevant government departments of the country should give strong support from the perspective of the development of national industries. As a community organization in the industry, industry associations have the responsibility and obligation to call and organize industry enterprises to jointly take measures and make recommendations to government departments.

This incident gives us an important warning. If the industry wants to develop in an international direction, it must understand and master the international rules of the game and raise awareness of prevention. Industry associations should strengthen exchanges and guidance in this regard. As far as the LED display application industry is concerned, the awareness of intellectual property protection of enterprises is also constantly improving. According to the incomplete statistics of the 127 member units of the LED Display Application Branch of China Optical Optoelectronics Industry Association, in 2007, the industry applied for 212 appearance and utility model patents and 44 invention patents; obtained 169 appearances and utility model patents and inventions. 11 patents; 67 software copyright registrations were registered, 65 software copyright registrations were obtained; 54 registered trademarks were applied, and 29 authorized trademarks were obtained.

However, we must see that in terms of core intellectual property rights such as LED materials and devices, given the current state of technology in China, our gap is still relatively large. Moreover, we may encounter many disputes or resistances in non-tariff trade barriers in the future, such as product technical specifications and standardization. After China joined the WTO (World Trade Organization), our preparations in this regard are still insufficient for enterprises. While moving to the international market, we must strengthen our work on intellectual property rights, as well as a targeted understanding of the non-tariff trade barriers in the target market areas, and develop positive risk prevention measures.

A long-term intellectual property development strategy is very necessary. In the early stage of industrial development, as the market is mainly concentrated in China, perhaps we will not be greatly affected. When industrial development begins to become international, intellectual property issues are inevitable. China's television, communications and even lighters and other industries have experienced this process. The establishment of a long-term intellectual property development strategy must first be undertaken by a specialized and professional organization or organization. At the same time, the government should give special funds support in the early implementation process. With a certain accumulation and development, we can continue to improve and develop by providing paid services to enterprises.
