Seoul Semiconductor, one of the world's leading manufacturers of light-emitting diode environmentally-friendly lighting technology, announced on January 7, 2008, in response to Nichia's “Design Patent Rights Case in the Northern District of California, USA†(US Design Patent Case) The erroneous statement, in the Central District Court of Seoul, South Korea, filed a defamation suit against Nichia, claiming 500 million won (about $531,000) for damages.
The products that Nichia has insisted on infringing its US design patents are actually limited to the 902 model, which is used for the backlight of mobile communication phones, and the sidelight LED products with a thickness of only 0.7mm. As for the termination notice of the product, it has been published to the public earlier.
Seoul Semiconductor has strongly tolerated the untrue and defamatory statements made by Nichia, and the relevant statements are not at the heart of the patent dispute. Finally, only by filing a lawsuit to prevent the Japanese company from issuing false statements, maintaining the truth of the facts around the world, and showing that Seoul Semiconductor is firmly committed to the event.
Last year, Seoul Semiconductor sent a friendly letter to Nichia to correct its misstatement. Instead of making corrections to its wrongdoings, the company has responded to Seoul Semiconductor’s defamation lawsuit.
